There are groups around the country who have filed lawsuits regarding the ban, but HUD says it's legal because it's about where someone - not whether someone smokes.

HUD notes that people "do not have to quit smoking" to live in government housing, but need to follow the new ban.

Ince said residents were given ample time to prepare for the new rule and have their questions answered.
